1. WHO IS THE TENTH CO?

In this Privacy Policy, any reference to “we”, “us” and “our” means all companies in THE TENTH CO group::

    and all of our other related companies. 

All of the THE TENTH CO companies are focused on providing you with the best products from the best & most premium ingredients and exceptional service and expertise.

2. DEFINITIONS

The following terms have the following meanings: 

Cookies means a small text file that is stored on a User’s computer/phone for record keeping purposes. 

Information means either Personal Information or Non-personal Information. 

Minor(s) means individuals below the age of 18 years.

Non-personal Information means any information that does not reveal your specific identity or does not directly relate to an individual. 

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, such as:

Products means the products offered by THE TENTH CO to Users.

User means an individual or company who interacts with THE TENTH CO services, including users of the Website and users who purchase products or services and otherwise interact with THE TENTH CO.

You and Your means the individual, Company, organization, partnership or similar that provides Information to us.

3. What is our Commitment to your Privacy?

THE TENTH CO is committed to protecting and respecting your privacy. 

THE TENTH CO complies with its obligations under the Privacy Act 1988 (Cth) (‘the Act’), the related Privacy Principles and the Heath Records Act 2001 (Vic) (‘Health Act’) when handling your personal information and information that is health information. 

This privacy policy sets out how we manage your personal information. We strongly encourage that you read it carefully.

The Privacy Policy applies to all personal information collected by THE TENTH CO when you access the Website, purchase any of our products or services, joini THE TENTH CO Loyalty Club or THE TENTH CO Affiliates or apply to join the THE TENTH CO team. 

We only collect Personal Information where you consent to the collection of this Information. However, should you refuse to disclose Personal Information to us, THE TENTH CO may be unable to provide you with the product or services you require. For example, if you purchase our great products online, we won’t be able to deliver these to you unless you provide a delivery address.

It does not  matter if the information or opinion is actually true or whether or not it is in writing. 

Essentially, information will be personal information if we are able to link this information to you and your identity. 

5. What Personal Information Do We Collect About You?

The personal information we collect and hold about you will vary pending the nature of your interaction with us. 

For example, we will collect different information from you if you join THE TENTH CO Loyalty Club than we will collect if you apply to join the THE TENTH CO team.

The types of personal information THE TENTH CO may collect and hold about you includes:

  • your name, residential and delivery addresses, telephone numbers, email and other electronic addresses;
  • your date of birth and gender;
  • information about the products and services you have purchased, ordered or inquired about;
  • information about the products and services you have obtained through THE TENTH CO Loyalty club;
  • your credit or debit card details and other bank details;
  • information about your subscription profile;
  • your views and insights about our business, products and services that you may provide through reviews, complaints or as a member of THE TENTH CO Makers;
  • information collected if you access the THE TENTH CO website or any of our social media sites. This may include but is not limited to your IP address. 

Data and other information collected from our website and social media sites via cookies. A cookie is a small text file that is stored on your computer/phone for record keeping purposes. 

  • if you apply for a job or position with us we may collect your name, contact details, working and education history and relevant record checks.

6. How do we collect Personal Information?

THE TENTH CO will collect your Personal Information directly from you when you visit our Website, deal with us over the phone, correspond with us in writing or engage with our products or services.  

Although we usually collect your personal information directly from you, sometimes we will collect it from other organisations or people. For example, we may collect personal information from our related companies. 

If we collect Information about an individual or company from someone else, we will take reasonable steps to ensure that the individual is made aware of this. In the event that THE TENTH CO receives unsolicited Personal Information, then we will, as soon as practicable. but only if lawful, destroy the Information or ensure the Information is kept confidential. 

When you apply for a job or position with us we may collect certain information from you from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or to engage you under a contract. This Privacy Policy does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.

7. WHY DO WE COLLECT YOUR PERSONAL INFORMATION?

We collect, hold, use and disclose your Personal Information for the purposes of operating our Website, providing our products and services and ensuring you have a safe and efficient experience. 

We may collect, hold, use and disclose your Personal Information for the following purposes:

  • to enable you to access and use our products, services and Website;;

  • to otherwise manage our business and to meet THE TENTH CO’s legal and regulatory requirements.

8. DIRECT MARKETING:

We may send you direct marketing communications and information about our service or products. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. You may opt-out of receiving marketing materials from us by contacting us.  

9. TO WHOM MAY PERSONAL INFORMATION BE DISCLOSED? 

We do not  sell your personal information to anyone else.

We may however, for the purposes listed in section 6, provide your personal information: 

  • to our related companies;
  • to THE TENTH CO’s contractors and service providers on a confidential basis. This information may only be used to help us manage our business;
  • as required by law; 
  • to any person that is a party to an agreement with THE TENTH CO for the sale of all or part of THE TENTH CO’s business, and
  • to any other person or organisation that we tell you about and you consent to

The other organisations and people that we provide your personal information to may be located outside of Australia. We may disclose Personal Data outside of Australia to third party suppliers, contractors or cloud providers located in various countries including New Zealand, Hong Kong, Japan, the European Union or the United States.

10. PROTECTING YOUR PERSONAL INFORMATION

We may hold your Personal Information in electronic form. Your personal information will either be stored on THE TENTH CO’s IT systems or the IT systems of THE TENTH CO’s contractors or service providers.If your personal information is initially collected in paper form, we will destroy that paper when and transfer your information to electronic form. 

We take reasonable steps to protect your Personal Information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your Personal Information. However, we cannot guarantee the security of your Personal Information.

THE TENTH CO’s authorised personnel will be provided with access to your personal information. These personnel are required to treat this personal information as confidential and deal with it in accordance with this privacy policy. The obligations are also imposed on contractors and service providers.

When we no longer require your personal information,THE TENTH CO will securely destroy it, unless there is a legal reason why THE TENTH CO needs to continue to hold that personal information.

11. WHAT HAPPENS TO NON-PERSONAL INFORMATION?

THE TENTH CO may collect Non-personal Information on the Website and via our products and services including but not limited to, which sections of the Website are most frequently visited, how often the Website sections are visited, how often our products and services are utilized and for how long the Website, products and services are used. This data is always used as aggregated, Non-personal Information and may be shared with THE TENTH CO agents and employees to provide them with information relating to how our visitors access and use our products, services and the Website. This is done for the purpose of providing you with the best and most efficient services.

11. SENSITIVE INFORMATION:

The Privacy Act protects your sensitive information, such as information about your religion, ethnicity, health or biometrics (for example, your fingerprints). If we need this type of information, we will ask for your permission, except where otherwise allowed by law. 

12. MINORS:

THE TENTH CO is for use by persons over the age of 18. We do not solicit or knowingly collect Personal Information from Minors. If we discover that we have received Personal Information from an individual who indicates he or she is, or that we otherwise have reason to believe is, a Minor, we will promptly delete such information from our systems. A Minor’s parent or legal guardian may request that the Minor’s Personal Information be corrected or promptly deleted from our files by contacting us via email at: hello@thetenthco.com.

13. HOW DOES THE TENTH CO USE COOKIES AND IP ADDRESSES

We may use Cookies or other similar tracking technologies on our Website, products or services that help us track your usage of our services and remember your preferences.  They enable the entity that put the Cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable Cookies through your internet browser, but our Websites, services and products may not work as intended for you if you do so.

We may also use Cookies to enable us to collect data that may include Personal Information. 15. YOU CAN ASK US ABOUT YOUR PERSONAL INFORMATION

THE TENTH CO will get back to you as soon as we can. We may not always be able to provide you with details about what we hold. In these circumstances we will explain this to you.

Where an individual requests to have Personal Information corrected, we will take reasonable steps to correct the Information as quickly as is reasonably possible, having regard to the purpose(s) for which it is held. If there is some reason why we don’t think the information should be changed, we will contact you and let you know. 

Alternatively, you can log into your Loyalty club account online and update your details. 

THE TENTH CO will not charge you for telling you about the personal information we hold or for making any amendments to that personal information.

Any complaints or requests received by us will be referred for prompt investigation by our team and a written response will be provided to you as soon as possible. 17. CHANGES TO PRIVACY POLICY

Our Privacy Policy is located on THE TENTH CO website, so it is easy for you to access.

We try not to change our privacy policy too often but may be required to if the law changes or if we change the way we collect or use your information. 

Subsequently, we may revise this Privacy Policy from time to time by updating this page. The revised Privacy Policy will take effect when it is posted on the Website

We will also put a notice on the THE TENTH CO website when we make significant updates, so you will be informed of these changes.

18. CHANGE IN CONTROL

If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our User databases, together with any Personal Information and Non-Personal Information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.
